Data Breaches Get Costly: Information Regulator Issues R5M Fines & Launches Online Reporting Portal
Data privacy enforcement in South Africa has entered an aggressive new phase. The Information Regulator has demonstrated its commitment to enforcing POPIA by issuing administrative fines up to R5 Million and launching a mandatory digital reporting portal.
Critical Incident Management Mandates
- Mandatory Section 22 Breach Notifications: When personal information is accessed or acquired by an unauthorized person, responsible parties must notify both the Information Regulator and affected data subjects "as soon as reasonably possible."
- Digital Submissions via eServices Portal: The Regulator has officially launched an online reporting platform. All Section 22 security compromise notifications must now be submitted digitally through the eServices portal.
- Enforcement Action & Personal Liability: High-profile administrative fines (including a R5 Million penalty against the Department of Basic Education) and enforcement notices issued to private sector bodies demonstrate the rising risk. Furthermore, Information Officers face personal criminal liability and fines under PAIA/POPIA for failing to comply with enforcement directives.
